Head-On Motor Vehicle Collision Results in a $2,700,000 Settlement

In July 2020, DLG’s client, a 63-year-old self-employed contractor, was driving on a two-lane highway heading home from a job site north of Sacramento.
A drunk driver (.21 B.A.L.) heading in the opposite direction at 45 m.p.h., looked down to answer a cell phone call. His vehicle veered into our client’s lane, resulting in a head-on collision. Our client was taken by ambulance to a local Emergency Room and was ultimately admitted to the hospital for 5 days with a mild traumatic brain injury, pneumothorax, rib fracture, fractured ulna (surgically repaired), the fractured kneecap (surgically repaired) and a sacral fracture. Following his discharge from the hospital, the client began to experience cervical and lumbar pain and radiculopathy. His care was transferred to his primary care physician, but he was only offered conservative treatment that did not yield results. John Demas and Tim Spangler took on the case and, wanting to help our client get back to his active and fulfilling lifestyle, retained an orthopedist, a physical medicine and rehabilitation specialist, and a neuropsychologist who were able to put together a comprehensive treatment plan to get the client back on his feet. After the completion of the discovery, the defense made a settlement offer of $400,000. The offer was rejected, and the case was meticulously prepared for trial. With the pressure of trial bearing down on the defense, John and Tim negotiated a $2.7M settlement for the client.
