SACRAMENTO – Demas Law Group recently obtained a $1.955 million settlement for a California sheet metal worker who suffered a serious spine injury after a rear-end accident.

The plaintiff, EH, was stopped in traffic when he was rear-ended. His vehicle slammed into the car ahead of him. The 56-year-old felt immediate neck and back pain and was transported by ambulance to the hospital, where he was diagnosed with cervical and lumbar strains and sent home.

Two days later, EH followed up with his physician about worsening neck and lower back pain. He was taken off work and saw a chiropractor, who sent him for x-rays and an MRI due to severe lower back pain that radiated down his left leg. The imaging tests revealed spinal instability in the lower vertebrae (L5-S1), a pars defect, and a large disc herniation.

The spinal injury could only be treated through surgery. Demas Law Group located a Stanford University-trained surgeon to operate four months after the collision. The surgery was successful, and the firm negotiated a quick settlement with the third party for $50,000 — their policy limits.

The law firm turned its efforts to recovering compensation through EH’s underinsured motorist policy. The labor-intensive nature of EH’s job made it impossible to return to work. With evidence from vocational and economic experts, Demas Law Group estimated EH’s wage loss and secured an additional $1.905 million from the insurance company.
